Present:- Councillors Calvert, Morrison (D), Roach, Nimmo, Sir Simpson Stevenson and Rebecchi, Councillor Morrison (D), Convener, in the Chair.
In attendance:- The Director of Central Services and Mr H McNeilly (for the Director of Legal Services).
An apology for absence was intimated on behalf of Councillor Clocherty.
The following paragraphs are submitted for information only, having been dealt with under the powers delegated to the Panel.
1399 RESOLUTION: EXCLUSION OF PUBLIC AND PRESS 1399
On the motion of the Convener it was agreed unanimously that, in terms of Section 50(A)(4) of the Local Government (Scotland) Act 1973, the public and press be excluded from the meeting during consideration of the undernoted item of business on the grounds that consideration of the item involved the likely disclosure of exempt information as defined in paragraph 6 of Part I of Schedule 7(A) of the Act.
1400 REQUEST FOR SUSPENSION OF TAXI DRIVER'S LICENCE: KENNETH P FORBES 1400
SUBMITTED: Report dated 10 December 1997 by the Director of Central Services on a request by the Chief Constable that the Council consider the suspension of the Taxi Driver's Licence held by Kenneth P Forbes on the grounds that Mr Forbes is no longer a fit and proper person to hold a Taxi Driver's Licence by virtue of the conduct detailed in the letter dated 17 February 1997 from the Chief Constable. The Panel heard Chief Superintendent Stewart, Ms Fiona Cook, agent for the applicant, and Mr Forbes.
After consideration, Councillor Nimmo moved that the licence be suspended immediately. As an amendment, Councillor Roach moved that the licence be not suspended. On a vote, 3 Members voted for the motion and 3 for the amendment and the Chairman, having given his casting vote, declared the amendment carried.
DECIDED: That the licence held by Mr Forbes be not suspended.
