In attendance:-  The Director of Central Services, Mr H McNeilly (for the Director of Legal Services) and Mr N McLaren (for the Director of Planning).

 

Apologies for absence were intimated on behalf of Councillors Nimmo and Sir Simpson Stevenson.

   878      APPLICATION FOR LATE HOURS CATERING LICENCE:  THE CHINA GARDEN,                      878

SUBMITTED:  Report dated 28 July 1997 by the Director of Central Services on an application for a Late Hours Catering Licence by Sau Har Chan to allow the operation of a hot food takeaway between the hours of 11.00 pm and 12 midnight on Sundays to Thursdays and between 11.00 pm and 1.00 am on Fridays and Saturdays at the premises known as The China Garden, 47-49 Cathcart Street, Greenock.

DECIDED:  That the application be granted.

SUBMITTED:  Report dated 28 July 1997 by the Director of Central Services on an application for a Late Hours Catering Licence by Wai Ling Wong to allow the operation of a hot food takeaway between the hours of 11.00 pm and 12.30 am on Sundays to Thursdays and between 11.00 pm and 1.30 am on Fridays and Saturdays at the premises known as The Wah Min, 122 West Blackhall Street, Greenock.

DECIDED:  That the application be granted.

SUBMITTED:  Report dated 28 July 1997 by the Director of Central Services on an application for a Late Hours Catering Licence by Tim Wong Tong to allow the operation of a hot food takeaway between the hours 11.00 pm and 12.30 am on Sundays to Thursdays and between 11.00 pm and 1.30 am on Fridays and Saturdays at the premises known as 43 Princes Street, Port Glasgow.

DECIDED:  That the application be granted.


1881      APPLICATION FOR LATE HOURS CATERING LICENCE:  THREE-IN-ONE,                                881

17 KEMPOCK STREET, GOUROCK

 

SUBMITTED:  Report dated 28 July 1997 by the Director of Central Services on an application for a Late Hours Catering Licence by Hamid Gharah to allow the operation of a hot food takeaway between the hours of (i) 11.00 pm and 1.00 am on Fridays and Saturdays; (ii) 11.00 pm and 12.30 am on Thursdays; (iii) 11.00 pm and 12 midnight on Sundays to Wednesdays; and (iv) on 24 and 26 December and 2 January in each year 11.00 pm to 1.00 am.

After discussion, Councillor Rebecchi moved that the application be granted between the hours of (i) 11.00 pm and 12 midnight on Sundays to Thursdays; (ii) 11.00 pm and 1.00 am on Fridays and Saturdays; and (iii) on 24 and 26 December and 2 January in each year 11.00 pm to 1.00 am.  As an amendment, Councillor Clocherty moved that the application be granted as sought.  On a vote, two Members voted for the motion and four for the amendment which was declared carried.

DECIDED:  That the application be granted as sought.

 

   882      APPLICATION FOR LATE HOURS CATERING LICENCE:  THE HIGHLAND STAR,                    882

39 REGENT STREET, GREENOCK

 

SUBMITTED:  Report dated 28 July 1997 by the Director of Central Services on an application for a Late Hours Catering Licence by Luk Yau Ho and Au Chueng Shek to allow the operation of a hot food takeaway between the hours of 11.00 pm and 12.30 am on Sundays to Thursdays and between 11.00 pm and 1.30 am on Fridays and Saturdays at the premises known as The Highland Star, 39 Regent Street, Greenock.  The Panel heard Mr McClure, agent for the applicant, in support of the application and Mr A Langan in support of his objection.

DECIDED:  That the application be granted.

 

   883      APPLICATION FOR VARIATION OF STREET TRADER'S LICENCE:  ANN MILLER                   883

 

SUBMITTED:  Report dated 31 July 1997 by the Director of Central Services on an application for Variation of Street Trader's Licence by Ann Miller to allow her to trade from a mobile snack bar at the new shops at Customhouse Way, Greenock between the hours of 8.00 am and 6.00 pm daily.  The Panel heard Mrs Miller in support of her application and Mr N McLaren in support of the representation submitted by the Planning Department.

DECIDED:  That the application be refused.

 

   884      APPLICATION FOR STREET TRADER'S LICENCE:  JOHN MULHOLLAND                                 884

 

SUBMITTED:  Report dated 28 July 1997 by the Director of Central Services on an application for a Street Trader's Licence by John Mulholland to allow him to trade from the mobile snack bar currently operated by Stephen McCaig at Hunter Place car park, Greenock between the hours of 11.00 pm and 3.00 am on Thursdays to Sundays.

DECIDED:  That the application be granted.


   885      APPLICATION FOR SECOND HAND DEALER'S LICENCE:  57 BELVILLE STREET,                   885

GREENOCK

 

SUBMITTED:  Report dated 30 July 1997 advising that authority had been received using the procedures under Standing Order  66 to grant a Second Hand Dealer's Licence to Heather Campbell to allow her to sell second-hand furniture and electrical goods at premises at 57 Belville Street, Greenock.

   886      APPLICATION FOR TEMPORARY PUBLIC ENTERTAINMENT LICENCE:                                   886

GREENOCK ARTS GUILD, CAMPBELL STREET, GREENOCK

 

SUBMITTED:  Report dated 29 July 1997 by the Director of Central Services on an application for a Temporary Public Entertainment Licence by Greenock Arts Guild Ltd in respect of premises at Campbell Street, Greenock to permit them to hold (i) a play, "The Dead Boy's Tale", on 29 August 1997 between 6.30 pm and 11.30 pm; (ii) a comedy, "Only an Excuse", on 1 and 2 September 1997 between 6.30 pm and 11.30 pm; and (iii) a children's show, "The Singing Kettle", on 21 September 1997 between 10.00 am and 10.00 pm.

DECIDED:  That the application be granted subject to conditions considered appropriate by the Director of Central Services.

 

   887      RESOLUTION:  EXCLUSION OF PUBLIC AND PRESS                                                                    887

 

On the motion of the Convener it was agreed unanimously that, in terms of Section 50(A)(4) of the Local Government (Scotland) Act 1973, the public and press be excluded from the meeting during consideration of the undernoted items of business on the grounds that consideration of the items involved the likely disclosure of exempt information as defined in paragraph 6 of  Part I of Schedule 7(A) of the Act.

 

   888      REQUEST FOR SUSPENSION OF STREET TRADER'S LICENCE:  DANIEL McCONNELL          888

 

SUBMITTED:  Report dated 31 July 1997 by the Director of Central Services advising of a request from the Chief Constable that the Council consider the suspension of the Street Trader's Licence held by Daniel McConnell.

DECIDED:  That the request be noted but that no further action be taken.

 

   889      REQUEST FOR SUSPENSION OF TAXI DRIVER'S LICENCE:  WILLIAM HANLEY                     889

 

SUBMITTED:  Report dated 3 July 1997 by the Director of Central Services on a request by the Chief Constable that the Council consider the suspension of the Taxi Driver's Licence held by William Hanley on the grounds that Mr Hanley is no longer a fit and proper person to hold a Taxi Driver's Licence by virtue of his previous conviction.  The Panel heard Acting Chief Superintendent Anderson, Mrs Black (agent for the applicant), Mr Mullen (the applicant's current employer) and Mr Hanley.

DECIDED:  That the licence held by Mr Hanley be not suspended.


   890`     APPLICATION FOR TAXI DRIVER'S LICENCE:  ALEXANDER BURKE                                        890

 

SUBMITTED:  Report dated 21 July 1997 by the Director of Central Services on an application for a Taxi Driver's Licence by Alexander Burke following an objection by the Chief Constable on the grounds that the applicant is not a fit and proper person to hold such a licence by virtue of his previous convictions.  The Panel heard Acting Chief Superintendent Anderson and Mr G Wright, agent for the applicant.

DECIDED:  That the application be refused.

 

   891      APPLICATION FOR TAXI DRIVER'S LICENCE:  PETER WILSON                                                  891

 

SUBMITTED:  Report dated 21 July 1997 by the Director of Central Services on an application for a Taxi Driver's Licence by Peter Wilson following an objection by the Chief Constable on the grounds that the applicant is not a fit and proper person to hold such a licence by virtue of his previous convictions.  Mr Wilson's mother appeared on behalf of her son.
