Approval of the minute as a correct record was moved by Councillor Fyfe with the exception of paragraph 226 (Public Conveniences). |

Councillor Fyfe moved that the narrative leading to the decision be amended by deleting on the fifth line “Councillor McCabe moved (1)” and substituting “it was agreed”; and on the ninth line, by deleting the following; “and (2)” and substituting “. Councillor McCabe moved”. |
|
|
Decided: that the minute as amended be approved. |
|
|
Councillor Fyfe seconded by Councillor Forbes moved that for paragraph (2) of the decision there be substituted the following:- |
|
|
(a) that
the public convenience at Albert Road, Gourock be retained; and (b) (i) that the decision to close the public
convenience at Kilblain Street, Greenock be initially for a limited period of
three months only during which an appraisal would take place to evaluate in
light of experience the impact of its closure on (a) the general public and
in particular those using public transport and (b) the problems experienced
by traders in the Kilblain Street area and perceived by them to be connected
with the presence of the convenience; (ii) that the views of Strathclyde Police be
obtained with regard to measures which might be put in place to deal with
problems alleged to be associated with the presence of the public
convenience; and (iii) that thereafter the future of the convenience be reviewed on the basis that if on the balance of public advantage it should be re-opened then the Council will require to find substitute savings to finance this. |
|

As an amendment to paragraph (2) Councillor McCabe moved seconded by Councillor Robertson that the public convenience at Kilblain Street, Greenock be retained with the convenience in Albert Road, Gourock being closed. On a vote 7 Members voted for the amendment and 12 for the motion which was declared carried. |
|
|

the minute as amended above be approved. |

There was submitted a report dated April 2004 by the Chief Executive as Returning Officer advising of the proposed polling places and stations to be used in the Greenock & Inverclyde and West Renfrewshire Constituencies at the European Parliamentary Election being held on 10 June 2004. |
|
|
Decided: that
the polling places and stations as indicated in the report be approved with
the proviso that changes required prior to the election will be implemented
in consultation with the appropriate Ward Councillor. |

Proposed Traffic Regulation
Order: Gillburn Road, Kilmacolm - Waiting Restrictions Revocation |

There was submitted a report by the Director of Corporate Services relative to the proposed Traffic Regulation Order in terms of the Road Traffic Regulation Act 1984 and Roads (Scotland) Act 1984 and associated regulations. It was noted that the making of the Order had been recommended for approval by the Planning & Traffic Management Sub-Committee on 7 April 2004. |

Resolved on the motion of Councillor Forbes
that “THE INVERCLYDE COUNCIL incorporated under the Local Government etc
(Scotland) Act 1994 RESOLVE TO MAKE as they HEREBY MAKE a Resolution under
Section 1 and Part iv of Schedule 9 of the Road Traffic Regulation Act 1984
to permit the revocation of waiting restrictions in Gillburn Road, Kilmacolm
all as detailed in a copy of the order forming a supplement to the principal
minute hereof and that the Head of Transportation & Roads Service and
Director of Legal & Support Services be authorised to take all necessary
action in connection therewith. |

There was submitted a report dated 2 April 2004 by the Director of Corporate Services requesting that The Inverclyde Council endorse the fuel poverty strategy which was considered by the Environment & Regeneration Committee on 23 March 2004. |

Decided:
that the fuel poverty strategy be endorsed. |

Standing Orders and Scheme of
Administration (1) Planning & Traffic
Management Committee Restriction on Delegated Powers (2) Formal Correction |

There was submitted a report dated 15 April 2004 by the Director of Corporate Services requesting the Council to consider the number of Members required to refer a decision to the Council under the relevant Standing Order and approve a formal correction to the Standing Orders following the recent review. The revised version of Standing Order 61(b) based on referral by 2 Members formed an Appendix to the report. Following discussion Provost Rebecchi, moved subject to the suspension of Standing Orders, that the membership of the Planning & Traffic Management Committee remain at 7 and that 2 Members be permitted to refer any decision back to the Council. As an amendment Councillor McCabe, moved subject to the suspension of Standing Orders, that the Committee comprise 9 Members and that 3 Members be permitted to refer a decision back to the Council. On a vote 6 Members voted for the amendment and 14 for the motion which was declared carried. |

Decided: (1) that
the formal correction of the Standing Orders and Scheme of Administration
detailed at paragraph 4.1 in the report be approved; and (2) that
Standing Orders be suspended and amended, as set out in the Appendix to the
report, to allow decisions from the Planning & Traffic Management
Committee to be referred to the Council by 2 Members. |

Freedom of
Information (Scotland) Act 2002 - Draft Publication Scheme |

There
was submitted a report dated 15 April 2004 by the Director of Corporate
Services advising of the provisions of the Freedom of Information (Scotland)
Act 2002 and requesting the Council to note the submission of a draft
publication scheme following authorisation under the powers delegated to the
Chief Executive to the Scottish Information Commissioner in compliance with
the requirements of the Freedom of Information (Scotland) Act 2002. Noted |

It was agreed in terms of
Section 50A(4) of the Local Government (Scotland) Act 1973 as amended, that
the public and press be excluded from the meeting on the grounds that
consideration of the following items involved the likely disclosure of exempt
information as defined in the respective paragraphs of Part I of Schedule
7(A) of the Act, as detailed in the Minute of the relevant Committee or
Sub-Committee. |
