Present:  Provost Roach, Councillors Calvert, Campbell, Hill, Hunter, Jackson, McCabe, McCormick, McGhee, Mitchell, Morrison (D), Morrison (M), Nimmo, O'Rourke, Rebecchi, Robertson (A), Robertson (Y) and White.

 

 

Chair:  Provost Roach presided.

 

 

In attendance:  Chief Executive, Depute Chief Executive, Director of Education Services, Mr H McNeilly (for Director of Legal & Support Services) and Director of Social Work & Housing Services.

NHS Argyll & Clyde - Board Membership

There was submitted a report dated 21 September 2001 by the Chief Executive (1) advising that, following the nomination of Councillor Hunter to serve as a Board Member of NHS Argyll & Clyde at the meeting of the Council held on 13 September 2001, the Chairman of NHS Argyll & Clyde had advised that the nomination could not be accepted and (2) requesting the Council to provide a nomination that complies with the requirements of membership of the NHS Board.

Following discussion, Councillor O'Rourke seconded by Councillor Robertson (Y) moved that Councillor Jackson be nominated to serve as a Board Member of NHS Argyll & Clyde.  As an amendment, Councillor Mitchell seconded by Councillor Nimmo moved (1) that no Member be nominated to serve as a Board Member of NHS Argyll & Clyde in the meantime and (2) that it be remitted to the Chief Executive to write to the Minister for Health & Community Care and the Minister for Justice expressing the Council's dismay at NHS Argyll & Clyde's decision to overturn the democratic decision of the Council to nominate Councillor Hunter.  On a vote, 7 Members voted for the amendment and 11 for the motion which was declared carried.

Councillor Mitchell requested that it be recorded in the minute of the meeting that the Liberal Democrat Group did not accept the advice (1) that it was not necessary to suspend Standing Orders to allow consideration of the matter as it was new business, although the Group accepted Provost Roach's ruling, and (2) that the nomination of Councillor Hunter was invalid.

 

 

Decided:  that Councillor Jackson be nominated to serve as a Board Member of NHS Argyll & Clyde.
