On behalf of the Council, the Provost expressed a warm welcome to Councillor Allan McGraw, who had been elected to serve as Member for Ward 13 following a by-election held on 21 September 2000.

Presentation of Bible

Reverend Crumlish, Reverend MacLean, Reverend Mill and Reverend Simpson were present on behalf of Greenock Presbytery and, prior to the commencement of business, presented a Bible to the Council.

 

The meeting adjourned to the Emergency Planning Room for the next item of business.

Presentation by Argyll & Clyde Health Board

The Council heard a presentation by Dr L Wilkie, Director of Public Health, accompanied by Mr K Thomson, Public Health Manager, Dr C Smith, Consultant in Public Health Medicine and Dr P Sweeney, Consultant in Dental Public Health, Argyll & Clyde Health Board on the Annual Report of the Director of Public Health 2000.  The representatives answered a number of questions raised by Members after which they were thanked for their attendance and departed from the meeting.

 

The meeting reconvened within the Council Chambers at 5.00 pm.

Planning and Traffic Management Sub-Committee - 4 October 2000

Approval of the minute as a correct record was moved by Councillor McCormick seconded by Councillor Robertson (Y).  Councillor McCormick seconded by Councillor Robertson (Y) moved with reference to paragraph 854(a) (Rowantreehill Quarry, Houston Road, Kilmacolm) that the decision of the Sub-Committee as minuted be approved.  As an amendment, Councillor Calvert seconded by Councillor Blair moved that planning permission be refused as the proposed siting of the dwellinghouse would have an adverse effect on the amenity of nearby residents.  On a vote, 8 Members voted for the motion and 9 for the amendment which was declared carried.

Councillor McCormick seconded by Councillor Robertson (Y) moved with reference to paragraph 854(b) (4 Nursery Grove, Kilmacolm) that the decision of the Sub-Committee as minuted be approved.  As an amendment, Councillor Calvert seconded by Councillor Hunter moved that planning permission be granted.  On a vote, 6 Members voted for the amendment and 13 for the motion which was declared carried.

 

 

Decided:

(1)   that planning permission for the erection of a dwellinghouse at Rowantreehill Quarry, Houston Road, Kilmacolm be refused as the proposed siting of the dwellinghouse would have an adverse effect on the amenity of nearby residents;  and

(2)   that the minute be otherwise approved.

Ward 13:  Election of Councillor - Appointments to Committees and Outside Bodies

There was submitted a report dated 25 September 2000 by the Director of Legal & Support Services on the filling of vacancies on Committees and Outside Bodies.

 

 

Decided:  on the motion of Councillor O'Rourke seconded by Councillor Mitchell:-

(1)   that Councillor McGraw be appointed to fill the vacancies on the Corporate Business Committee, the Education Services Committee, the Community and Protective Services Committee, the Licensing and Registration Panel and the Education Services (Appeals) Sub-Committee;

(2)   that Councillor McGraw be appointed to serve as the Council's representative on the Larkfield Community Association and the Inverclyde Branch of the Scottish Veterans' Garden City Assoc (Inc);

(3)   that Councillor Morrison (M) be appointed a Trustee of the Peter Stanton Memorial Trust;

(4)   that Councillor Nimmo be appointed to serve as the Council's representative on the Barlinnie Prison Visiting Committee;

(5)   that Councillor Hunter be appointed to serve as a substitute Member on Strathclyde Passenger Transport Authority;  and

(6)   that, subject to suspension of Standing Orders, Councillor McCabe replace Councillor Morrison (M) on the Finance and Audit Sub-Committee.

Resolution:  Proposed Compulsory Purchase Order, Greenock Waterfront, East India Harbour

There was submitted a report dated 29 August 2000 by the Director of Legal & Support Services recommending that the Council make a Compulsory Purchase Order in respect of land at Greenock Waterfront, East India Harbour.

Resolved on the motion of Councillor McGhee seconded by Councillor McCormick that "THE INVERCLYDE COUNCIL as planning authority for the area of Inverclyde RESOLVE TO MAKE as they HEREBY MAKE in terms of Section 189 of the Town & Country Planning (Scotland) Act 1997 and the Acquisition of Land (Authorisation Procedure) (Scotland) Act 1947 a Compulsory Purchase Order entitled "Greenock Waterfront - East India Harbour Compulsory Purchase Order (No 3) 2000" authorising them to purchase compulsorily the subjects at Victoria Filling Station, Rue End Street, Greenock which subjects are described in the Schedule to the Order and shown outlined in red on the plan marked "Map referred to in the Greenock Waterfront - East India Harbour Compulsory Purchase Order (No 3) 2000", a copy of which is appended to the principal minute hereof", and that the Director of Legal & Support Services be instructed to submit the said Compulsory Purchase Order to the Scottish Executive for confirmation and to deal with all matters arising from or in consequence of the making and confirmation of the said Order.

Resolution:  Proposed Traffic Regulation Order - Dunlop Street, Greenock:  No Stopping

There was submitted a report dated 13 September 2000 by the Director of Legal & Support Services relative to the making of the Traffic Regulation Order - Dunlop Street, Greenock: No Stopping in terms of the Road Traffic Regulation Act 1984 and Roads (Scotland) Act 1984 and associated regulations.  It was noted that the making of the Order had been recommended for approval by the Planning and Traffic Management Sub-Committee of 6† September 2000.

Resolved on the motion of Councillor McGhee seconded by Councillor McCormick that "THE INVERCLYDE COUNCIL, incorporated under the Local Government etc (Scotland) Act 1994, RESOLVE TO MAKE as they HEREBY MAKE a Resolution under Sections 1(1), 2(1) to (3) and Part III of Schedule 9 of the Road Traffic Regulation Act 1984 to introduce no stopping in Dunlop Street, Greenock, all as detailed in a copy of the Order forming a supplement to the principal minute hereof" and that the Head of Transportation & Roads Service and the Director of Legal & Support Services be authorised to take all necessary action in connection therewith.

Managing Change in the Water Industry - A Consultation Paper - Use of Emergency Powers Procedure

There was submitted a report by the Director of Community & Protective Services advising of the use of the Emergency Powers Procedure under Standing Order 66(b) to submit a response on behalf of the Council to the Scottish Executive Consultation Paper "Managing Change in the Water Industry".

 

 

Noted

 

 

It was agreed in terms of Section 50(A)(4) of the Local Government (Scotland) Act 1973 as amended that the public and press be excluded from the meeting on the grounds that consideration of the following item involved the likely disclosure of exempt information as defined in the respective paragraphs of Part I of Schedule 7(A) of the Act as detailed in the Minute of the relevant Committee or Sub-Committee.
