In attendance:- The Chief Executive, the Depute Chief Executive, the Assistant Chief Executive (Economic Development and Urban Regeneration), the Assistant Chief Executive (Social and Community Development), the Director of Central Services, the Director of Legal Services, the Director of Finance, the Director of Education Services, the Director of Property and Technical Services, the Director of Planning, the Director of Social Work, Mr G Morgan (for the Director of Information Technology), the Director of Transportation and Roads and the Chief Environmental Services Officer.
An apology for absence was intimated on behalf of Councillor Robertson (A).
Prior to the commencement of business, the Provost extended congratulations to the Head Teacher and staff of Glenburn School who recently gained a National Schools Curriculum award and also to Mr Alan Gilchrist, Director of Property and Technical Services, on his appointment as President of the Association of Chief Architects in Scottish Local Authorities.

Approval of the minute was moved by Councillor Mulholland seconded by Councillor Jackson.
Councillor Mulholland seconded by Councillor Jackson moved with reference to paragraph 367 (Efficient Management of Resources: Enhancing Provision in Schools) that the decision as minuted be approved. As an amendment, Councillor Campbell seconded by Councillor Finnie moved:- (a) That a full and open review of all schools within Inverclyde be carried out as a matter of urgency; and (b) That no alternative use of any school surplus accommodation be made unless a report is submitted to the Education Services Committee for approval. On a vote, 7 Members voted for the amendment and 12 for the motion which was declared carried.
DECIDED: That the minute be approved.

PROPOSED AMENDMENT TO STANDING ORDERS AND SCHEME OF ADMINISTRATION: TRAFFIC REGULATION ORDERS - ESTABLISHMENT OF TRAFFIC MANAGEMENT SUB-COMMITTEE |

SUBMITTED: Report dated 10 March 1997 by the Director of Central Services on a recommendation by the Transportation and Roads Committee that the Council agree to the suspension of the relevant Standing Order to permit amendment of the Council's Standing Orders and Scheme of Administration to allow the establishment of a Traffic Management Sub-Committee. It was proposed that such a Sub-Committee act with delegated powers to consider and determine Traffic Management proposals promoted in terms of the Road Traffic Regulation Act 1984 and Roads (Scotland) Act 1984 and associated Regulations where an objection or objections have been lodged against the proposal and have not been withdrawn, the membership of the Sub-Committee to comprise the Convener and Vice-Convener of the Transportation and Roads Committee, one other Member from the Majority Group and two from the Minority Groups with provision for substitute Members drawn from the Transportation and Roads Committee.
Councillor Roach seconded by Councillor McGhee moved that the relevant Standing Order be suspended and this was agreed unanimously.
DECIDED:
(a) On the motion of Councillor Roach seconded by Councillor McGhee that the Council RESOLVE to AMEND the Council's Standing Orders and Scheme of Administration in terms of the amendments as follows:-
Standing Orders
For Standing Order 63(c) substitute the following:-
(c) Standing Sub-Committees
Personnel Committee - Personnel (Appeals and Applied Conditions of Service) Sub-Committee
Education Services (Appeals) Sub-Committee
Traffic Management Sub-Committee, each of which shall have a minimum of 4 Members
Scheme of Administration
Under heading 3 of the introduction (DEFINITION OF TERMS AND PROVISIONS APPLICABLE TO ALL COMMITTEES) there shall be inserted at sub-heading (b) Delegated Functions the following additional paragraph:-
(4) There shall be delegated for determination by the Traffic Management Sub-Committee all traffic management proposals promoted by The Inverclyde Council in terms of the Road Traffic Regulation Act 1984 and Roads (Scotland) Act 1984 and associated Regulations and which have been the subject of one or more unresolved objections received by the Council.
Renumber the remaining paragraphs under this section accordingly.
Transportation and Roads Committee
There shall be added to the current remit of the Committee the following:-
(4) Traffic Management Sub-Committee
To consider and determine Traffic Management Orders and Traffic Regulation Orders promoted by the Council where an objection or objections have been lodged against a proposal and have not been withdrawn.
(b) That the membership of the Sub-Committee be the Convener and Vice-Convener of the Transportation and Roads Committee, one other Member from the Majority Group and two from the Minority Groups to be notified to the Director of Central Services with provision for substitute Members drawn from the Transportation and Roads Committee.

JOINT CONSULTATIVE COMMITTEES: APPOINTMENT OF MEMBERS |

SUBMITTED: Report dated 26 March 1997 by the Director of Central Services on a recommendation from the Personnel Committee that the Council consider the appointment of representatives to serve on the Joint Consultative Committees for APT&C staff and manual workers and craft operatives respectively and also that an Officer of the Council be appointed to act as Joint Secretary of each Joint Consultative Committee.
DECIDED:
(a) That the 11 Members of the Personnel Committee be appointed to serve on both Joint Consultative Committees; and
(b) That the Director of Central Services be appointed as one of the Joint Secretaries of both Joint Consultative Committees.

RESOLUTION: TRAFFIC REGULATION ORDER, DUBBS ROAD (SERVICE ROAD), PORT GLASGOW |

SUBMITTED: Report dated 10 March 1997 by the Director of Central Services on a recommendation by the Transportation and Roads Committee that the Council make a Traffic Regulation Order at Dubbs Road (service road), Port Glasgow.
RESOLVED on the motion of Councillor Roach seconded by Councillor McGhee that:-
The Inverclyde Council RESOLVE TO MAKE as they HEREBY MAKE, a Resolution under Sections 1 and 6 and Part III of Schedule 9 of the Road Traffic Regulations Act 1984 to make an Order to permit only one-way traffic driving southwards in Dubbs Road (service road), Port Glasgow from Boglestone Avenue to Dubbs Road, all as detailed in a copy of the Order forming a supplement to the principal Minute hereof; and that the Directors of Transportation and Roads and Central Services be authorised to take all necessary action in connection therewith.

RESOLUTION: TRAFFIC REGULATION ORDER - ON-STREET PARKING PLACES (WITHOUT CHARGES) ORDER NO 1 1997 |

SUBMITTED: Report dated 10 March 1997 by the Director of Central Services on a recommendation by the Transportation and Roads Committee that the Council make a Traffic Regulation Order - On-Street Parking Places (Without Charges) Order No 1 1997.
RESOLVED on the motion of Councillor Roach seconded by Councillor McGhee that:-
The Inverclyde Council, incorporated under the Local Government etc (Scotland) Act 1994, RESOLVE TO MAKE as they HEREBY MAKE, a Resolution under Section 32(1) and Part III of Schedule 9 of the Road Traffic Regulations Act 1984 to make an Order to restrict parking within designated parking bays to disabled drivers only at the locations in Port Glasgow, Greenock and Gourock detailed in the schedule relating thereto, all as detailed in a copy of the Order and schedule forming a supplement to the principal Minute hereof; and that the Directors of Transportation and Roads and Central Services be authorised to take all necessary action in connection therewith.

KIRKIN' OF THE COUNCIL SERVICE |

SUBMITTED: Report dated 27 March 1997 by the Director of Central Services advising that, due to the imminent commencement of a major refurbishment programme at Wellpark Mid Kirk, Greenock, alternative arrangements would require to be made for the annual Kirkin' of the Council service and recommending that the service be held for this year only within Cartsdyke Parish Church, Greenock.
DECIDED: That the annual Kirkin' of the Council service be held within Cartsdyke Parish Church, Greenock on Sunday 18 May 1997.

RESOLUTION: EXCLUSION OF PUBLIC AND PRESS |

On the motion of the Provost it was agreed unanimously that, in terms of Section 50(A)(4) of the Local Government (Scotland) Act 1973, the public and press be excluded from the remainder of the meeting on the grounds that consideration of the remaining items involved the likely disclosure of exempt information as defined in the respective paragraphs of Part I of Schedule 7(A) of the Act, the nature of which is set out in the Minute of the Committee which considered each respective item in the Appendix to the Minute.
